The testimony only goes to show how much MORE incompetent USCIS is going to become if CIR passes... 35 million applications + more!!!!
Why bother with paperwork, wave some hands and declare all of them legal.

I talk to USCIS CC/IO last week. She told me that it will take approx 90 days to assign my case to AO. So my case is still getting dust on room and not with officer. It's sucks but wait continue...
    PD: July 2001 (EB-3 India)
    RD: July 2nd 2007
    ND: Oct 10th 2007

I have bigger problem to worry about. I am process of lay-off from employer whom I am working last 7 years. :)

Oh..that hurts. I assume you will have to invoke AC21. All the best to you.

90 more days? Which service center is your case located? I assume Texas? Did she explain whats the reason for the delay? Did she tell you about namecheck status? Are you planning on an Infopass? (sorry too many questions, but I think we are both on a similar boat )

Looks like our PDs are very close to each other. Lets hope for the best.

Guys whoever planning to use EAD going forward get ready for $700- per head out of pocket every year. That is the cost of renewal for EAD & AP without attorney involvement. Add additional family members and you can understand why was July bulletin made current.

Lots of revenue at our expense .......

Called 6 different operators at the USCIS and got different answers (atleast they are consistently inconsistent!)

2 Said it is perfectly fine as long as the amount is correct
3 said they prefer seperate checks but if the amount is correct they will accept it
1 said they will reject the whole package.

On a lighter note i spoke to one really sweet lady when my call was escalated. All i wanted to ask was about the checks, but she (very enthusiastically) looked up my information and informed me that i was not in the system yet and actually apologised to me. Now i KNOW she looked it up coz she got my middle and company names right even without my telling her that. She even said she has received a few calls today and the guy b4 me was a lucky caller as he was in the system as of Aug 8.

Guess what I discovered today? I found the filled in W7 form and notarized copies of my wife's passport in my house. All this while I was so confident that I did send the W7 form along with tax return form, but it turned out I forgot to do so :(. I called IRS and they told me that I need to fill in Amended Tax Return form (Form 1040X) now. On the contrary, my tax preparer (CPA) is saying I just need to resend Form 1040 and W7 and there is no need to amend as there is no change in figures. Whose words should I follow now? Please advise.

In my view, you would have to file form 1040X since IRS processed your original 1040 after changing it to married filing separately.

CAn you please help with the process on how to take an infopass.

    Sorry for my ignorance.

    Thanks in advance,
    Shana

Also, if i-140 is revoked , that should trigger NOID or RFE which the lawyer will handle (hopefully successfully).
    GCCovet

Remember, the NOID/RFE goes to your Attorney if you have submitted G-28 form. If not, it comes to you.

Following this logic only BEC cases are affected.
I use the word "only" caughtiously because there are still a lot in BECs and if it is you it is not a statistic.

If BECs complete processing by year end then all I140s could be issued within a few months of that.

After BEC cases have been processed then what's the problem since PERM is workable?

The only problems I see are:
BEC cases -- it is unacceptable to leave them out in the cold after such a long wait.
Abusive employers cancelling I140 before a new I140 is obtained after moving jobs.

The extension beyond 6th year was only ever intended to allow for the labor certification backlog.

Unfortunately the law makers acted too late and many had to leave some years ago before 7th year extensions were allowed. I hope they don't make up for that by acting too soon now (before BECs complete processing).

If the BECs complete their job, why would there be a need for 7th year extensions?

    Hello,

I think you are fine to do day trading on any visa type.

Just because you conduct multiple transactions per day does not legally imply that you are paying any less attention to your regular job.

If you are called for an AOS interview, a curious IO may ask how did you manage both, but you can always show that you did your job well by providing copies of your performance evaluations and/or letters from your supervisors/HR.

In summary, good luck w day trading! Do donate part of the profits to IV... :)

Once a person accepts employment using EAD, he/she gives up non-immigrant status. Next time, when he/she applies EAD renewal he/she must write the present "immigration status" in the renewal from. That time he/she can not write "H4", while working on EAD.

Similarly, when working on EAD, you can not apply for H4 extension. All your" A" number indicates what status you are in to USCIS.

May be 10% might have become entrepreneurs...? Definitely not everyone has started a 10person or even 1 person company....People are doing good but they just work as programmers or so called project managers...you know its not a big deal to become a Project manager in India..

    But 150K entrepreneurs...:p
The rate at which the economy in India is growing, that figure might not be incorrect. Do not underestimate what people can do, times are changing and changing fast, all i can say is, green card ke chakkar mein duniya aage nikal gayi.

I am not sure if this is what you are looking for...please check this. It says someone on "Parole" may be eligible non-citizen.

    Source:Completing the FAFSA 07-08/The Application Questions(14-31) (http://studentaid.ed.gov/students/publications/completing_fafsa/2007_2008/ques2-1.html)
Citizenship status. You can receive federal student financial aid only if you are a U.S. citizen or an eligible noncitizen. If you have changed from a noncitizen to a citizen and have not informed the SSA, contact the SSA to update your status. Otherwise, the SSA may report that you are not a citizen, and you will have to provide citizenship documentation before receiving aid.

For financial aid purposes, an eligible noncitizen is one of the following:

A U.S. permanent resident who has a Permanent Resident Card (I-551 or I-151)
    A conditional permanent resident (I-551C)
A noncitizen with an Arrival-Departure Record (I-94) from the Department of Homeland Security (DHS) (specifically, the U.S. Citizenship and Immigration Services) showing any one of the following designations: "Refugee," "Asylum Granted," "Parole" (the I-94 must confirm 'paroled for a minimum of 1-year and status' has not expired), or "Cuban-Haitian Entrant"
If you are neither a citizen nor an eligible noncitizen, you are not eligible for federal student aid; for example, you are not eligible if you are in the U.S. on one of the following:

    An F-1, F-2, or M-1 student visa
    A J-1 or J-2 exchange visitor visa
    A B-1 or B-2 visitor visa
A G series visa (pertaining to international organizations)
An H series or L series visa (allowing temporary employment in the U.S.)
A "Notice of Approval to Apply for Permanent Residence" (I-171 or I-464)
An I-94 stamped "Temporary Protected Status"
However, you may be eligible for state or institutional aid and may therefore wish to complete the FAFSA to apply for that aid. If you are completing a paper FAFSA, fill in oval C. On FAFSA on the Web, indicate that you are not a citizen by using the drop down menu. Please note, however, that if you do not have a Social Security number, the processor will not process your FAFSA. If you are in this situation, you should contact your school for information on how to proceed.

Talk to an attorney. Either way it will be money well spent. From what I have heard, these non-compete clauses are very weak and generally unenforceable. Typically, these clauses are applicable for very high level jobs where you may be in a position to benefit a competitor due to your inside knowledge of the current company. Recently, Microsoft had sued one of its senior level employee who left to join Google on the non-compete issue. From what I read the last about it, Google aggressively defended its employee and the case was dismissed.

I would suggest talking to an attorney specializing in contracts.
