I thinks EB3 INDIA will move between 9/11/2001 to JAN 2004 , because after 9/11 probably few people applied for GreenCrd because of market condition, even h1b quotas are not used for 2002 and 2003, i applied for h1b on 2004 April , no surprise the quota available because of market condition.

Im really not sure if this helps EB3 cases. for example in my case i have a bachelors degree + 10 years expereince and stuck in EB3. I dont think this will help me because I dont have an US degree.

My employer says EVL is not required for 485 filing. How do I make him understand that it is required? Any links from USCIS website or any authentic info will be helpful. I searched and couldn't find it!! TIA

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?
Think Positive- that's the first prerequisite for positive things to happen.

Brother your assumption is flawed if someone come under reservation category they get their guaranteed reservation seat (on their merit basis in that class) if reservation % is fulfilled as per rule then their application goes to open category. That means 50% resources is for everyone in India.
This was happened few years back to get admission in one of top Medical school after scoring more than 92% was not able to get to desired top medical school but one of his friend who had just scored 58% was able to get in top notch medical school. Now this remind me similar situation what was happened 50 years before. Now making matter worst student who had got 92% was belonging to very middle class or you can say poor family but his friend was belonging to class one gazetted officer�s family (I would classify them upper middle class).
I think reservation was required in past to up-lift backward class and give them justice in system but now situation is change drastically we see people from all class is on same page .if someone wants to argue on this that is fine. In real sense if we need reservation then it should be on economics basis everyone should file taxes and they should get reservation accordingly with merits .In this way government will get more revenue and on the whole we will have fair justice to everyone (all cast )and this will provide better visibility what is happening to normal families. Now some will debate how we can avoid fraud for reporting low income then hey that is what government should be doing, proving infrastructure and enforcing rule of law other than that government has no business in dictating which cast is upper cast or lower cast.
Now real question pose by the other users here are we better-off here or back home? I think we always indulge in material benefits but there are other aspect of life you cannot put face value on it .What matter is the most are you Happy? What is your ultimate goal of life? What is the most important thing you want to have in your life? What is the most irritating thing you cannot overlook or make you uncomfortable? On top of all these key questions what are tools /resources available to you to address all these likes dislikes. So let us say if you are shooting for quality life then define what must have for that life and to get those you may have to bite bullet and compromise on some of those. If you can find middle ground some where there then we call those people happy people or successful people. So life is about making right choice all the time as per your own situations. When we are in this fine-tuning process we can always use help from our resources, friends, relative, culture, God, Money and our own intellectual.

My best friend (brightest among all of my school friends) in India belonging to Backward class could not study medicine or engineering because he had (no money) to support his family..... so he finished his shortest teaching course and became public school teacher.... He was capable of getting into any medical school without reservation help... and because he belonged to lower cast he was assured in any medical college with the help of reservation.... this reservation system does not work for real lower cast or for people who really need uplifting..... between I could not get into medicine because I was 1 mark short...... I have a bad feeling about IVs goals. Are you only concerned about getting the GC backlogs cleared? or are you going to be asking for H1b related issues to be addressed too? eg:- H1b renewal after the 6th year is an issue any moron could easily understand and pass. That has been there for many years and should continue for a successful H1b program. Please take care of that issue too. I dont see that included in the letter you have prepared to be sent out to all the senators. Please do that urgently. This is a very techinical issue and can easily be campaingned for. Pls dont ignore it.
If the number 3 in the letter has something to do with H1b renewal, pls reword it and make it clear, however, Idont believe its related to h1b renewal atall.
Please include atleast H1b renewal, one good thing about h1 that all of you have/currently are enjoying, to be included as one of your/our major demands. I am not asking for the H1b placement at different sites thing, that might be difficult to campaign for at this point of time, however, renewal needs to be done.

For those of you joining us late, here is some info about this thread.
1. This is to do our least part to the core IV Team for their selfless sacrifice, for all of us getting the benefits of legal immigration. Note that , Aman Kapoor , the co-founder of IV has done his part by sacrificing $64,000/- from his own personal funds towards the administrative costs of IV. Yes you read it right , it is $64,000/- We come to know from his co-worker that he has sold his house towards running this show for us.
2. We have not yet figured out a way to reimburse these costs as IV does not yet have administrative costs part of the expenditure allocation, as we understand it. So instead of a wait and watch, we decided to go ahead with collecting the pledge from the members on the amount they are putting forth for reimbursing the amount. Once we come up with a strategy(members we look for your suggestions on how to get this done, please add your comments) we will instruct the members pledged to pay out.
So do not pay it directly to the IV core funds, yet.
Please help us spread the message about this thread in other threads by copy and pasting the following in other threads too.
There is a funding drive in this other thread towards reimbursing Aman and other core IV member's expenses towards the administrative costs of IV.

You can do all you want and be as blunt. USCIS doesn't have to answer to you. Stop chanting the "HIGHLY SKILLED", paying all taxes, nonsense. You were not brought to the USA at gun point. You chose to come (and stay). The USA can just put one ad in the newspaper anywhere in the world and there will be 10 million highly skilled NEW people they can bring. They do not need you (us). It is important to remember that we are not doing anyone a favor by being here except yourselves.

You have still not answered my question - where did you get the idea that I am here self imposing high standards? You have talked about everything else but that. So you have decided to take refuge by not answering the main reason why I said you are making accusations.
